Lindal Windows Limited Warranty

This warranty applies to Retrofit Windows only, and not windows supplied directly by Lindal Cedar Homes as part of a complete Lindal house package. Please contact your local Lindal dealer for details regarding the window warranty when supplied as part of a complete house package.

WINDOW FRAMES AND PARTS

Lindal window frames and parts are warranted against defects in workmanship or materials for a period of one (1) year from the date of factory shipment, on the conditions stated herein. These requirements must be met to maintain warranty:

1. Proper utilization of head flashing
2. Exterior perimeter caulking
3. Windows, including those factory stained or primed by Lindal, must receive a finish coat within 30 days of delivery.

INSULATED GLASS

Lindal insulated glass is warranted against material obstruction from dust of film formation or moisture accumulation between the sealed panes of glass resulting from failure of the perimeter seal due to defective materials or workmanship, for a period of ten (10) years from the date of manufacture, on the conditions stated herein.

This warranty does not apply to any unit that has a corner angle other than 90 degrees, any unit installed at an angle that exceeds 15 degrees from vertical, or any unit installed with any other part of the glass sealant exposed to sunlight.

LINDAL WINDOWS MAKES NO EXPRESSED OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, CONCERNING THE PERIMETER SEAL OF SUCH UNITS.

EXCEPTIONS

Warranties stated herein extend only to the original purchaser and do not apply to any products that have been mishandled, abused, misused or not used for the purpose intended, improperly installed by persons other than Lindal employees, damaged in shipments that were not the responsibility of Lindal, or damaged by any other cause whatsoever that was not within the exclusive control of Lindal Building Products.

SELLER MAKES NO EXPRESS WARRANTIES CONCERNING THE PRODUCT OTHER THAN THE WARRANTIES STATED HEREIN. ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE IS LIMITED TO THE DURATION OF THIS WRITTEN WARRANTY AND THE PRODUCTS COVERED THEREBY. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

EXCLUSIVE REMEDY

Lindal's obligation under the warranties stated herein is limited solely to repair or replacement, at Lindal's option, of defective products at no additional charge. This obligation is conditioned on the buyer giving Lindal written notice of any claimed defect within the applicable warranty period and ten (10) days prior written notice of any return shipment of goods. Lindal reserves the right to inspect any product claimed to be defective prior to any return, repair or replacement of the product. If Lindal elects to supply a replacement unit under this warranty, such replacement shall not extend the time period of this warranty and the replacement unit shall be warranted only to the extent of the remaining portion of the warranty period on the original purchase.

The remedy provided herein is the exclusive remedy for breach of any warranty, expressed or implied. All shipments of repaired or replacement products shall be F.O.B. manufacturer's warehouse. Lindal shall not be liable for any costs of shipment, removal, or installation of any product, or for any incidental or consequential damages for any breach of warranty or other breach or Lindal's obligation. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This warranty gives you the specific legal rights, and you may also have other rights which vary from state to state.
